What Is Temporary Protected Status (TPS)? 

From civil war and armed conflict to severe hurricanes and earthquakes due to changing climate temperatures, TPS permits nationals of designated countries to reside in the U.S. on a temporary basis due to unsafe conditions in their country. TPS is designated by the Department of Homeland Security to foreign countries with unsafe conditions that temporarily prevent nationals from returning. The Secretary of Homeland Security may designate a country for the following reasons: 

  • Ongoing armed conflict, such as civil war
  • An environmental disaster, such as an earthquake or hurricane
  • Other extraordinary and temporary conditions

Benefits of TPS

There are numerous benefits to obtaining TPS status as an immigrant in the United States. Noncitizens who are TPS beneficiaries or found preliminarily eligible for TPS upon their initial case review are: 

  • Not removable from the U.S.
  • Permitted to apply for employment authorization document (EAD)
  • Allowed to apply for travel authorization

Limitations of TPS

While TPS is a temporary benefit that does not lead to lawful permanent resident (LPR) status or other immigration status, it doesn’t prevent noncitizens from taking active steps to secure lawful residence in the U.S. Individuals who register for TPS are still permitted to: 

  • Apply for nonimmigrant status
  • File for adjustment of status based on their immigrant petition
  • Apply for any other immigration benefit or protection for which they are eligible
