Analyzing The Barriers To Legal Immigration In The U.S.

|

Finding a pathway to legally immigrate to the U.S. can be an overwhelming and confusing process that is filled with numerous barriers. At Griffith Immigration Law, we prioritize understanding the unique challenges that immigrants face and advocating for immigrant rights. Below are just a few barriers that can be faced during the immigration process. Contact us today to learn more about how we can help you overcome these barriers and make your dreams of legal immigration a reality.

Magnifying Glass over Visa

Diversity Visa Lottery System

The Diversity Visa Lottery System was established in 1994 and is usually the only option for immigration for those without a college degree or a family or employer sponsorship. In practice, the rules of the lottery system make it difficult to qualify, and even if you do, your chances of being selected are less than one percent!

Work Permitted Application Approved

Employer Sponsorship

Employers can help a family immigrate by sponsoring an employee. However, one of the biggest barriers is that even if the applicant meets all the employer’s requirements, U.S. workers will always be in line first. This can significantly restrict immigrant workers from entering the American workforce. In most cases, for “less-skilled” workers, the employer will have to petition for the worker.

Passport and Visa

No Documentation? No Green Card

Unauthorized and undocumented immigrants who reside in America already are not eligible to obtain a green card. The only way these individuals can obtain a green card is if they first leave the country and apply because of how they initially entered the U.S.

Family of Four Hugging

Family Sponsorship

It is also possible for immediate family members to sponsor immigrating family members. There are no caps for sponsoring the immigration of minor children, spouses, and parents of U.S. citizens. However, every other family member has an annual cap which can be very restrictive for siblings, aunts, uncles, and cousins.

The immigration law in the U.S. can be complex and difficult to navigate, which is why it is important to have an experienced immigration lawyer on your side. At Griffith Immigration Law, we are dedicated to providing immigrants with the resources they need to make their dreams of coming to the United States a reality. Contact us today to find out how we can help you overcome the barriers to legal immigration in the U.S.
